Privacy Policy

Fintrack Pty Ltd (ACN 006 164 709) “Fintrack or Us or We” acknowledges that privacy is important. This Privacy Policy applies to any Fintrack Service. You expressly consent to the information handling practices outlined in this policy by using or viewing the Fintrack Service in any manner whatsoever.

This Privacy Policy is incorporated into and is subject to the Fintrack Service Terms and Conditions of Use. Any viewing or use of any kind of the Fintrack Service and any personal information you provide through the Fintrack Service are subject at all times to this Privacy Policy and the Terms and Conditions of Use.

DEFINITIONS

Through out this policy the following definitions apply. " Fintrack Service/s" means:-
  1. the application and platform controlled, operated or produced by Fintrack
  2. the Fintrack web site at kondoot.com (the "Site")
  3. live broadcasting services on the Site
  4. the uses linked to and permitted by Fintrack
  5. all tools associated with a Fintrack account
  6. Mall services provided by Fintrack

"Fintrack /We" means the corporation that provides Fintrack Services and its officers, directors, employees, affiliates, agents, licensors, suppliers or representatives or any other party involved in creating, producing or delivering the Fintrack Service.

You/User" means any person, company/entity ("Business") accessing the Fintrack Service any person who uses, subscribes to, publishes through, joins or visits kondoot.com or Fintrack Services.

1. The Information We Collects:

You may provide information to Fintrack in several ways.

1.1 Information you provide

Through your use of Fintrack Services you may provide what is generally considered "personally identifiable" information. Such information may include your name, email address, credit card number or postal mailing address.

1.2 Information Automatically Collected

When you access the Fintrack Service (including through your computer or your mobile device) or open one of our HTML emails, we may automatically record certain information from your system by using different types of tracking technology. Through the use of this technology we may track the content and pages that you access on the Fintrack Service, and the dates and times that you visit the Fintrack Service.

"Cookies" Information: When you access the Fintrack Service, we may send one or more cookies, small text files containing a string of alphanumeric characters to your computer. Fintrack may use both session cookies and persistent cookies. A session cookie expires after you log out. Persistent cookies can be removed by adjusting your web browser settings. All cookies are encrypted for security purposes.

1.3 Information you choose to share with members

You may establish a profile on any of Fintrack’s websites. If you do you may authorize/select friends or associates to view your profile and these persons can view the information on your profile including your comments, videos and broadcasts etc. You expressly consent to sharing information on your profile in this manner when you permit selected/authorized friends or associates to access your profile.

1.4 Information you choose to share with the public

You can also choose to permit the public to view your broadcasts etc. You expressly consent to sharing these broadcasts with the public when you choose this setting on the broadcast page on your profile.

2. The way we use Information:

Fintrack uses the information that you provide or that we collect to:

  1. operate, maintain and deliver all of the features and services found on the Fintrack Service;
  2. track user-generated content and Users to the extent necessary to comply with applicable laws;
  3. understand the usage trends and preferences of our Users;
  4. enhance the way the Fintrack Service operates and looks;
  5. create new features if users so desire
  6. delete redundant features

We may use your email address, without further consent, for administrative communications such as notifying you of major Fintrack Service updates, for customer service purposes, and to send privacy or security related notices. Fintrack may use Automatically Collected information and Cookies information to record your information so that you will not have to re-enter it every time you access the Fintrack Service.

Fintrack may use information collate generic or aggregate non-personally identifiable data to provide:-

  1. customised third-party advertisements;
  2. monitor and report on the effectiveness of third-party marketing campaigns;
  3. track and report aggregate usage data such as total number of videos’ and pages accessed; and
  4. monitor entries, submissions, and status in any promotions or other activities.

3. Disclosure:

Fintrack does not share your personally identifiable information with third parties for marketing or promotional uses without your express prior consent. However, it is important to note that any personally identifiable information that you voluntarily choose to display on any publicly available portion of the Fintrack Service such as the public broadcast feature on your profile becomes publicly available and may be collected and used by others without restriction.

Fintrack permits customized advertising content that we hope enhances user experience i.e. products or services that our users may have a genuine curiosity or interest in. So Fintrack may disclose aggregate or generic data (NOT-personally-identifiable data) to interested third parties to assist those parties in understanding the usage and demographic patterns for certain content, services, data may include anonymous User usage data, referring / exit pages and URLs, platform types, number of clicks and the like.

We may disclose some limited User information to affiliated companies or other businesses or persons to:

  1. provide web site hosting, maintenance, and security services; fulfil orders;
  2. conduct data analysis and create reports;
  3. offer certain features or functions;
  4. assist Fintrack in improving the Fintrack Service and creating new services features.

Fintrack shall contractually require that these parties process such information in compliance with this Privacy Policy. In this case a limited use of any information is permitted. Fintrack shall at all times require these parties to use reasonable and prudent confidentiality measures.

Fintrack may be compelled to disclose User information by law or in the good-faith belief that such action is necessary to comply with state and federal laws (for example Australian copyright or trademark law) or court order or legal proceedings.

Fintrack expressly reserves the right to disclose User information that we believe, in good faith, is appropriate or reasonably necessary to:-

  1. mitigate or protect Fintrack against liability;
  2. enforce Fintrack Terms and Conditions of Use;
  3. protect Fintrack from unlawful uses;
  4. to investigate and defend Fintrack against third-party claims or allegations;
  5. to assist government law enforcement agencies;
  6. to maintain and protect the security or integrity of the Fintrack Service;
  7. protect the rights of users,
  8. protect the personal safety of users, or others.

4. Access to your Personal Information

You may decline to provide personally identifiable information. In this case Fintrack will not be able to provide to you some of the features and functionality found on the Service. For example if you choose not to provide a user id and password you will not be able to create a profile on this website. If you choose to establish a profile you may delete your account and cease use of the Fintrack Services at any time.

5. Protect your password

Fintrack shall take all reasonable precautions to protect your privacy at all times. Such measures include use of sophisticated encryption technology.

6. Advertisers

Fintrack does not provide your personally identifiable information to advertisers. Fintrack does permit third-party advertisers to provide advertisements in the Fintrack Service. These third parties may use technology to send, directly to your browser, the advertisements that appear within the Fintrack Service and they may automatically receive your IP Address and other log file information when this happens.

These third parties may also use other technologies (such as cookies, JavaScript, or web beacons) to personalize their advertisements. We hope that this enhances our experience, as they are able to view ads that are relevant and meaningful to their circumstances.

Advertisers may request generic or non- personally identifiable data to identify certain audiences. Should you respond to as advertisement, the advertiser may conclude that you fit the description of their desired audience. You should consult the respective privacy policies of these third-party advertisers. This Privacy Policy does not apply to these third parties. Fintrack reserves the right to add or remove third-party advertisers

7. Data Security

We know security is important and we make every effort to safeguard and preserve the integrity and security of your personal information. We utilize numerous measures, including encryption technology to ensure the security of our systems.

However we cannot ensure or warrant the security of any information you provide to Fintrack, and you do so at your own risk. Once we receive your information. However we must note that we cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

If Fintrack becomes aware of a security systems breach, we may:-

  1. attempt to notify you by email so that you can take appropriate protective steps; or
  2. we may broadcast or post a notice on the Fintrack Service

8. Merger or Sale

Where Fintrack is acquired by a third party we reserve the right to transfer or assign the information that we have collected from Users as part of that acquisition, sale, or other change of control.

9. Third Parties

This policy applies to the security of your personal information on Fintrack Services only. We cannot control the privacy policies of third parties, even if you provided your information to this third party through Fintrack Services. You should review the third party privacy policies for your protection.

This Privacy Policy may be revised without further notice to you. Please revisit this page to stay abreast of any changes. Use of the Fintrack Service constitutes your agreement to this Privacy Policy and any revised versions.
